What is a good cookie banner I can choose? How does it impact my GDPR compliance?

While choosing a cookie banner to comply with GDPR, you must ensure the following:

  1. Get explicit user consent before placing nonessential cookies like the ones for advertising or analytical purposes.
  2. Ensure full transparency by clearly communicating the purposes of the cookies and how their data will be processed.
  3. Add an option that allows users to opt out; deny consent or be able to refuse easily.
  4. Ensure that users have adequate flexibility to adjust and choose the cookies as per their preferences. For example, they should be able to accept all cookies, only necessary cookies, and deny marketing cookies).
  5. Obtain informed consent prior to the storing of those cookies on the user’s device.

In practice, you’ll need to show a cookie banner (also called cookie notice) upon the user’s first visit, allowing the user to provide consent. Prior to consent, no cookies — except for those exempt — should run or be installed.

Failure to comply with GDPR cookie rules can result in fines or penalties, making it crucial for organizations to manage cookie consent in a compliant manner.

There are several companies and products that offer GDPR-compliant cookie consent solutions to help businesses manage user consent and ensure adherence to GDPR and ePrivacy regulations:

  • Cookiebot: A widely used consent management platform that scans websites for cookies, ensures compliance, and provides customizable consent banners.
  • TrustArc: Provides GDPR-compliant cookie consent solutions, including banners, opt-out options, and automatic tracking to ensure compliance.
  • Termly: Offers a customizable cookie consent manager that integrates with websites to manage consent and provide legal compliance with GDPR.
  • CookieYes: A tool designed to help websites comply with GDPR and other privacy laws by generating cookie banners, capturing consent, and managing cookie categories.
  • Civic Cookie Control: An open-source tool that provides websites with customizable cookie consent banners and control over cookies.
